Trak Agents LLC (“TA”) is an limited liability company and is the owner and operator of this Site. The following are the terms and conditions that govern the use of the Site. THESE TERMS AND CONDITIONS OF USE (“TERMS”) CONSTITUTE A LEGAL CONTRACT BETWEEN YOU AND TRAK AGENTS. PLEASE READ THESE TERMS IN THEIR ENTIRETY BEFORE YOU CONTINUE TO USE THE SITE. BY USING OR BROWSING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST DISCONTINUE USING THE SITE.
DISCLAIMER
Here at “Trak Agents” we will walk you through the process step by step to earn you a possible placement. “Trak Agents” will negotiate all deals for any tracks submitted to us. Do not send us any tracks that you may possibly have someone else working on, that can cause conflict of interest. All tracks submitted to “Trak Agents” must be the clients original and copy written material, without any clearance or sanction issues from another person, business or artist. If at any time it is discovered that the client has intentionally submitted any tracks, that are not legally their own-you will be in breach of contract and will forfeit any monies paid to sign up with “Trak Agents” and also could also be sued for punitive damages (time and service). Once you sign up to become a client with “Trak Agents” we guarantee you that we will work hard to get you a possible placement but cannot guarantee you a placement. All funds paid to “Trak Agents” are non refundable, we believe in the services that we are offering and we know that you won’t be disappointed. Services are rendered and begin on the day that the client’s payment is made in full via PayPal. “Trak Agents” will submit your tracks for some of the following opportunities: Albums, mixtapes, commercials, and movie soundtracks. If a track(s) that you have submitted through “Trak Agents” gets selected for an actual placement deal, there is a 30% commission fee to be deducted from the front end made payable to us. You keep all your back end (royalties and publishing) commissions.
OWNERSHIP OF THE SITE
The Site is owned and operated by Trak Agents LLC. All of the content featured or displayed on the Site, including, but not limited to, logos, written text, graphics, photographs, images, moving images, sound, illustrations and software as well as the underlying code which creates the Site (collectively “Content”), is owned or controlled by TA, or entities which have granted certain rights to TA. Further, all elements of the Site, including, but not limited to, the general design and the Content, are protected by copyright, trademark, trade dress, moral rights and other laws relating to intellectual property rights. The “TRAK AGENTS” logo is a trademark of TA and may be registered throughout the world.
NO UNAUTHORIZED USE
You may not you use in any way (a) the “Trak Agents” logos or icons to hyperlink other web sites with the Site, or (b) the Content, TA’s name, trademarks, trade names, service marks, or any patented designs for any reason. If you wish to take any of these actions, please contact us.
SUBMISSION OF SONGS
All tracks submitted must be the clients original material. If you are a musician or an individual or entity who has the required rights to certain musical recordings, you may submit your recordings by executing the Trak Agents Client Agreement. The term and conditions contained in that agreement govern your submission of such recordings. In addition to the terms set forth in that agreement, your use of the Site is governed by these Terms.
PRIVACY POLICY
Your privacy is important to us. Trak Agents respects your rights to privacy. We will not share any of your personal information with outside parties.. We only use the information that you give us to help further getting you a placement.
